Firm Files Environmental Contamination Lawsuit in Louisiana

Burns Charest attorneys are serving as co-counsel in litigation claiming that a former rail yard in Lafayette, La. contains soil and water contaminants that threaten public health. The lawsuit seeks an injunction and declaratory judgment against defendants that include Union Pacific Railroad Company, Consolidated Companies Inc. and Southern Pacific Motor Trucking Company, and calls for a comprehensive assessment of the entire 40-acre site so that a cleanup plan can be designed. The property sits above the Chicot Aquifer, the source of the city’s drinking water. Elizabeth Roche and Korey Nelson of the firm’s New Orleans office are co-counsel in the lawsuit, which claims that the defendants should be found liable for the contamination and cleanup of the property.
