Court Delivers Big Win for Burns Charest Clients in EpiPen Litigation

The United States Court of Appeals for the Tenth Circuit has upheld a district court’s order that previously certified two classes of plaintiffs in claims alleging racketeering and state antitrust claims against Mylan and Pfizer, the manufacturers of the EpiPen allergy suppression device

“This is one of the last hurdles we faced in bringing these companies and their leadership to justice and holding them accountable,” says the firm’s Warren Burns, co-lead counsel for the plaintiffs.  “We’re confident this case is going to a jury early next year.  On behalf of all the American allergy sufferers and businesses injured by defendants’ conduct, we look forward to that day.”
